Mid Vermont Christian School, a private K–12 institution in Quechee, Vermont, is challenging a new state education law known as Act 73 in federal court.
The school previously made headlines after it was banned from state athletic competitions by the Vermont Principals’ Association in 2023, following its decision not to play a girls’ basketball game against a team with a transgender athlete.
Now, the school has filed a federal lawsuit claiming that Vermont’s new eligibility requirements for tuition funding violate its rights.
Under Act 73, passed in 2025, private “approved independent schools” can only receive public tuition payments if they meet specific criteria — including having at least 25 percent of enrolled students publicly funded during the 2023–2024 school year.
State officials say these rules are meant to standardize oversight and ensure accountability for all schools receiving taxpayer dollars.
Critics, however, argue that the criteria make it nearly impossible for smaller religious schools to qualify — effectively excluding them from the tuition program.
And right when you think it’s just another policy debate, there’s a twist hidden in the fine print.
But here’s where it gets interesting — that eligibility clause everyone’s talking about? Here’s what it really means.
Because most Christian schools in Vermont serve small, locally funded student populations, very few meet the 25 percent threshold. That means even schools already approved for academic quality could lose access to tuition funding.
The school’s legal filing argues that this violates the Free Exercise Clause of the U.S. Constitution, referencing Supreme Court rulings such as Carson v. Makin (2022), which held that states cannot deny public benefits to schools based solely on their religious status.
The case is currently before the U.S. District Court for the District of Vermont, and its outcome could determine how the state applies its new education funding system going forward.
