In a landmark decision, the Sixth Circuit Court of Appeals ruled against the Olentangy Local School District in Ohio, saying the district cannot force students to use peers’ preferred pronouns. The court determined this policy violates the First and Fourteenth Amendment rights of students. Simply put, schools cannot compel speech, meaning students can speak according to their beliefs without punishment.
The court highlighted that the district failed to prove that refusing to use a peer’s preferred pronouns would disrupt the classroom, a standard from Tinker v. Des Moines.
