CHRISTIAN BREAKING NEWS: Supreme Court of India Stays Criminal Proceedings against BJP Leader Annamalai in ‘Hate Speech’ Case related to Christian Missionary NGO

In his plea, the BJP leader emphasized that there were no unpleasant reactions or outbursts of violence from the public following the video interview.

On Monday, the Supreme Court stayed criminal proceedings against Tamil Nadu Bharatiya Janata Party State President K. Annamalai in response to a complaint accusing him of hate speech for claiming that a Christian missionary NGO was behind a petition filed in the top court seeking a ban on the bursting of firecrackers during Deepavali.

A Bench led by Justice Sanjiv Khanna issued the interim order while serving formal notice on Salem-based activist V. Piyush, who had filed the case against Mr. Annamalai, who was represented by senior advocates Siddharth Luthra and M.A. Chinnasamy.

The BJP leader sought the Supreme Court after the Madras High Court declined to dismiss the criminal prosecution against him in a Salem Magistrate Court.

The suit accused Mr. Annamalai of using hate speech in an interview in October 2022 when he stated that “a Christian missionary had filed writ before the Supreme Court against the bursting of crackers during Diwali”.

The Magistrate accepted Mr. Piyush’s complaint despite the fact that the Tamil Nadu Police Cyber Cell had dismissed the charge that the comment was hate speech.

According to the appeal, the Magistrate summoned Mr. Annamalai without conducting an inquiry or even seeing the video footage of the interview.

Mr. Annamalai contended that the High Court declined to dismiss the matter notwithstanding its previous findings that there was no “primary facie case” against him.

The leader of the BJP pointed out that a “parallel was drawn to Hitler, genocide of Jews, etc, and that the said speech is a ticking time bomb which will burst any time”.

He stated that there were no negative reactions or outbursts of violence from the public following the video interview.

The court scheduled the case for Apr. 29, 2024.
