US District Judge Haywood S. Gilliam Jr. issued a preliminary injunction requiring the Oakland Unified School District (OUSD) to allow the Child Evangelism Fellowship’s (CEF) Good News Clubs with equal access to school facilities as nonreligious groups such as Girls on the Run and Berkeley Chess School.

The court found that OUSD had engaged in viewpoint discrimination, which violated the First and Fourteenth Amendments. Judge Gilliam dismissed the school district’s argument that allowing the clubs would violate the Establishment Clause, citing that the meetings are voluntary, held after school hours, not school-sponsored, and require parental consent.

The ruling leans heavily on the Supreme Court’s 2001 decision in Good News Club v. Milford Central School, which established that religious clubs cannot be excluded if secular ones are allowed.

It also reinforces the Equal Access Act, which protects student-led non-curriculum clubs, including religious ones, from discrimination at schools that allow other groups.

CEF, represented by Liberty Counsel, filed suit in December 2024 after being repeatedly denied access to four campuses, despite previously holding Good News Clubs pre-pandemic.

Denials were based on reasons such as “not a good match,” lack of space—even when available—and objections to evangelism on campus.

The judge pointed out the district’s legal defense lacked solid precedent, whereas established case law supported CEF’s claim.

Liberty Counsel is pursuing a permanent injunction to secure ongoing access. Meanwhile, Judge Gilliam has directed both parties to agree on a plan for implementation by September 16, with a case management meeting scheduled for September 23.

This is a major win for religious freedom, free speech, and parental rights. Advocates see it as upholding constitutional protections for Christian students. Critics raise questions about the separation of church and state, though the court’s ruling aligns with longstanding legal precedent.
