The UK Supreme Court, in case UKSC 2024/0095, has ruled that Northern Ireland’s current Religious Education curriculum and collective worship arrangements are unlawful.
Why?
Because the curriculum does not meet the legally required standard of being objective, critical, and pluralistic — a requirement under Article 2 of Protocol 1 of the European Convention on Human Rights.
For decades, Northern Ireland’s RE syllabus has been shaped by the four main Christian churches — the Roman Catholic Church, the Church of Ireland, the Presbyterian Church, and the Methodist Church. But when a parent — supported by Humanists UK — challenged the system after their child received exclusively Christian instruction with no meaningful teaching about other religions or non-religious worldviews, the Court ruled in their favor.
The Justices put this in unmistakable legal terms:
Teaching that is not objective, critical, and pluralistic amounts to pursuing the aim of indoctrination.

And the ruling is absolute.

The Court also addressed a crucial point:
The right of parents to withdraw their children from RE does NOT fix the problem.
Why?
Because the curriculum itself — not just the lessons — is built in a way that lacks neutrality.
The Supreme Court noted this places an “undue burden” on parents and risks stigmatizing children.

The judgment also confirms that the Northern Ireland Department of Education is already considering a review of the RE curriculum, and that this will “inevitably” include Religious Education.

This is the line inside the ruling that changes the tone of the entire case:
A curriculum that is not objective, critical, and pluralistic is — in legal terms — indistinguishable from indoctrination.

This is not about Christianity being removed.
This is about how education must be structured from now on.
From this ruling forward, any RE curriculum — and any future policy related to how worldviews are taught — must meet this same legal test of neutrality and pluralism.
This detail will shape every future debate about faith, worldview, and education in Northern Ireland.
