Earlier this week, US District Judge David Alan Ezra issued a preliminary injunction blocking the University of Texas System from enforcing key provisions of Senate Bill 2972, known as the Campus Protection Act, which banned virtually all protected expression on public university campuses between 10 PM and 8 AM.
The law, passed after protests on campus drew national attention, imposed broad restrictions on expressive activities, including amplified sound, guest speakers, prayer meetings, and late-night outreach. Critics, including Christian student groups, argued that it violated the First Amendment.
Students from the University of Texas at Austin and UT Dallas, supported by the Foundation for Individual Rights and Expression (FIRE), filed the lawsuit, arguing the law infringed upon their constitutional rights. Christian groups like FOCUS voiced concern that the law would prevent them from meeting students in need and sharing God’s love during late hours.
Judge Ezra agreed, temporarily halting enforcement and ruling that several provisions are likely unconstitutional. He emphasized that “The First Amendment does not have a bedtime,” highlighting that government restrictions cannot arbitrarily limit when students may exercise their constitutional rights. Supporters of free speech and religious expression are calling this a major victory.
