En correspondencia con el firme y sostenido compromiso de apoyar y contribuir en todo lo posible a los esfuerzos internacionales legítimos para poner fin al genocidio que se comete contra el pueblo palestino, el gobierno de la República de Cuba ha decidido intervenir en el procedimiento contencioso iniciado por la República de Sudáfrica contra el Estado de Israel ante la Corte Internacional de Justicia.
Atendiendo a las disposiciones del Artículo 63 del Estatuto de la Corte, y en estricta observancia de sus obligaciones como Estado Parte de la Convención para la Prevención y la Sanción del Delito de Genocidio, Cuba hará uso de su derecho a presentar, como Tercer Estado, su interpretación de las normas de la Convención que Israel ha violado flagrantemente con sus acciones en el territorio palestino ilegalmente ocupado de la Franja de Gaza.
La demanda presentada ante el principal órgano judicial de la Organización de las Naciones Unidas, tiene como objetivo principal detener las atrocidades contra el pueblo palestino como resultado del uso desproporcionado e indiscriminado de la fuerza por parte de Israel.
Israel, con total impunidad, protegido por la complicidad del gobierno de los Estados Unidos, ignora sus obligaciones como Potencia Ocupante en virtud del Cuarto Convenio de Ginebra.
El genocidio, el Apartheid, el desplazamiento forzado y los castigos colectivos, no pueden tener cabida en el mundo actual, ni pueden ser tolerados por la comunidad internacional. Debe prevalecer la justicia y el respeto a la Carta de las Naciones Unidas y el Derecho Internacional.

In accordance with the firm and sustained commitment to support and contribute in every way possible to legitimate international efforts to put an end to the genocide committed against the Palestinian people, the government of the Republic of Cuba has decided to intervene in the contentious procedure initiated by the Republic of South Africa against the State of Israel before the International Court of Justice.
Pursuant to the provisions of Article 63 of the Statute of the Court, and in strict observance of its obligations as a State Party to the Convention on the Prevention and Punishment of the Crime of Genocide, Cuba will exercise its right to present, as a Third State, its interpretation of the norms of the Convention that Israel has flagrantly violated with its actions in the illegally occupied Palestinian territory of the Gaza Strip.
The application filed before the principal judicial organ of the United Nations has as its main objective to stop the atrocities against the Palestinian people as a result of the disproportionate and indiscriminate use of force by Israel.
Israel, with total impunity, protected by the complicity of the United States government, ignores its obligations as an Occupying Power under the Fourth Geneva Convention.
Genocide, apartheid, forced displacement and collective punishment have no place in today’s world, nor can they be tolerated by the international community. Justice and respect for the United Nations Charter and international law must prevail.
Cuba will join South Africa’s case before the International Court of Justice (ICJ), accusing Israel of “genocide,” according to a Foreign Ministry statement.
According to the statement, the legislation aims to
“stopping the atrocities against the Palestinian people as a result of Israel’s disproportionate and indiscriminate use of force.”
South Africa filed a case against Israel over the Gaza war in December of last year, alleging that Israel had violated its commitments under the Genocide Convention.
Last month, the court ordered Israel to end genocide against Palestinians and do more to protect civilians, but it did not order a ceasefire as South Africa had sought.
In response to South Africa’s emergency request, the International Court of Justice ordered Israel to “immediately halt its military offensive, and any other action in the Rafah governorate, which may inflict on the Palestinian group in Gaza conditions of life that could bring about its physical destruction in whole or in part.”
Despite international outcry, the IDF launched its offensive in the city, which is expected to take many weeks to complete.
