On Wednesday, State Attorney Andrew Bain declared that an inquiry revealed no wrongdoing and that his team will not file charges against the pastor.
“There was an older school handbook that allowed for corporal punishment and a newer handbook where the language had been deleted.”

He and his team studied police files from Orlando indicating that 16 kids received physical punishment.
“We went through and looked at the statutes and case law, and it was determined later that we could not file criminal charges.”

The “gray area” between the old and new handbooks ultimately means that the state cannot establish beyond a reasonable doubt that the pastor hit the students with the purpose to cause physical or mental injury, which is illegal in Florida.
Statement from Alpha Learning Academy:
“After working closely with the law enforcement investigation following the incident at The Alpha Learning Academy, we have now learned that no criminal charges are being filed. We are currently working with our district leadership to determine next steps regarding the pastor’s tenure, as well as how the school will operate moving forward. The pastor’s voluntary sabbatical will continue while we work through this internal process.
“Our commitment is to ensure the school continues to be a place where every scholar is “cared for, loved and supported in their desire to be the best they can be” and that the church remains a place of compassion, hope, and reconciliation.
“As our internal investigation is now underway, we will refrain from any further comment.”
Parents at an Orlando private school were enraged and demanded justice after accusing a pastor of beating their children with a belt on Thursday afternoon.
Pastor Terence Gray, according to the parents and one of the students, stepped into the fourth grade classroom at St. Mark AME Church’s Alpha Learning Academy and accused the youngsters of misbehaving.
